1. About these terms
These terms govern your use of the Adventure Trader website and services ("the platform"). By creating an account or using the platform you agree to them. They are subject to the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA), where applicable.
2. Our role
Adventure Trader is an online marketplace that connects buyers and sellers. Unless expressly stated, we are not a party to any sale, do not own the items listed and do not take possession of them. The contract of sale is between the buyer and the seller.
Adventure Trader applies identity, listing and fraud-prevention checks, but buyers must still conduct appropriate inspections and due diligence.
3. Accounts
- You must be 18 or older and able to enter into binding contracts.
- You must provide accurate information, including a valid South African mobile number where requested.
- You are responsible for keeping your login credentials secure.
- We may suspend or place a security hold on accounts suspected of fraud or breaching these terms.
4. Verification badges
Badges indicate that specific checks were completed at a point in time. They are not a guarantee of a person's conduct or of an item's condition, title or history.
5. Listings and seller obligations
- You may only list items you own or are authorised to sell, and must disclose known defects and any finance or encumbrance.
- Listings must be accurate, lawful and not misleading. Stolen, counterfeit or prohibited goods are not permitted.
- Dealers selling in the ordinary course of business must comply with the CPA, including implied warranty of quality.
6. Fees
Current fees are shown on our pricing page and include VAT. Paid promotions start when activated and run for the stated period.
7. Prohibited conduct
You may not use the platform to commit fraud, harvest data, spam users, circumvent fees, or post content that is unlawful, defamatory or infringes the rights of others.
8. Liability
To the extent permitted by law, Adventure Trader is not liable for losses arising from transactions between users, the condition of items, or users' acts or omissions. Nothing in these terms limits rights you have under the CPA that cannot lawfully be excluded.
9. Changes
We may update these terms. Material changes will be notified by email or on the platform before they take effect.
